Welcome to our mental performance app for golf. These Terms of Service (“Terms”) govern your use of the mobile application and services provided by COCODIGITAL SL (“we,” “us,” or “our”), a company based in Málaga, Spain.
By accessing or using our App, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. ELIGIBILITY
By using this App, you represent and warrant that you are at least 13 years of age. If you are under the age of 18, you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf.
2. SUBSCRIPTIONS AND FREE TRIAL
- 7-Day Free Trial: We offer a one-time 7-day free trial for our annual subscription.
- Automatic Conversion: At the end of the 7-day trial period, your subscription will automatically convert into a paid annual subscription, and you will be charged the full annual fee.
- Cancellation: To avoid being charged, you must cancel the subscription at least 24 hours before the trial period ends through your App Store (Apple) or Google Play Store settings.
- Billing: All payments are processed by third-party app stores. We do not store your credit card information. Refunds are subject to the policies of Apple or Google.
3. INTELLECTUAL PROPERTY & AI CONTENT
- Ownership: All content, including but not limited to audio tracks, scripts, software, and branding, is the exclusive property of COCODIGITAL SL.
- AI-Generated Content: Our audio sessions utilize advanced Artificial Intelligence (AI) voice technology. These assets are proprietary. You are strictly prohibited from using our audio to train, fine-tune, or develop other AI models or voice-cloning technologies.
- Streaming Only: Content is provided via streaming only. You are prohibited from downloading, extracting, recording, or distributing our audio files outside of the App.
4. MEDICAL & PERFORMANCE DISCLAIMER
- Not Medical Advice: Our App provides tools for mental performance and focus. We are not medical professionals. The content is for informational and entertainment purposes only and does not constitute psychological or medical therapy.
- No Guaranteed Results: Golf is a game of skill and many variables. COCODIGITAL SL does not guarantee any specific improvement in your golf handicap, tournament performance, or physical ability.
5. SAFETY WARNING
Golf courses can be hazardous environments.
- Situational Awareness: Do not use the App or listen to audios in situations where you need full auditory awareness for safety (e.g., driving a golf cart, walking in areas where “FORE” may be called, or during active play where you may be at risk of being struck by a ball).
- Assumption of Risk: You use the App at your own risk. COCODIGITAL SL is not liable for any physical injury or property damage occurring during the use of the service.
6. PROHIBITED USES
You agree not to:
- Reverse engineer the App.
- Use any automated system (bots, scrapers) to access the service.
- Bypass any geographical or technical restrictions.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, COCODIGITAL SL shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App. Our total liability shall not exceed the amount you paid for the service in the last 12 months.
8. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
